New Federal High Visibility Safety Vest Requirement

It has come to the attention of the Minnesota Emergency Medical Services Regulatory Board (EMSRB) that a new federal requirement for use of high visibility safety vests by all roadside workers including emergency responders will take effect on November 24, 2008. It should be noted the EMSRB does not have regulatory authority over this federal requirement. However, the EMSRB would like to make sure ambulance services are aware of this requirement and have some resources available to provide information about the use of high visibility safety vests by emergency responders working in dangerous areas. This new federal requirement affects all responders who are within the right-of-way on a Federal-aid highway.



According to a report by the National Association of State EMS Officials (NASEMSO), Federal Regulation 23 CFR 634 states that, by November 24, 2008 “All workers within the right-of-way of a Federal-aid highway who are exposed either to traffic (vehicles using the highway for purposes of travel) or to construction equipment within the work area shall wear high-visibility safety apparel. NASEMSO encourages the use of the 4 or 5 point break away “public safety” vests that are among those approved for this use. NASEMSO states “Even if you don’t have a ‘Federal-aid’ highway in your response area or do not perceive yourself subject to the standards, the minimal investment in safety vests is the right thing to do for your at-risk colleagues…and any of us that respond to car crashes are at-risk”.
 

Note: The Federal Highway Administration has determined that Class II Vests complying with ANSI/ISEA 107, 2004 or 2006 and Public Safety Vests complying with ANSI/ISEA 207, 2006 meet the intent of this new rule.
